Terms of Use
This Terms of Use (this "Terms") contains the terms and conditions that govern your access to and use of the Rabata data storage platform (the "Rabata Service") and is an agreement between you ("you" or "your") and RCS Technologies ("Rabata," "we," "us," or "our").
1. Use of the Rabata Service
1.1 Access
Subject to the terms and conditions of this Agreement, Rabata hereby grants you a non-exclusive, non-transferable, non-sublicensable right to access and use the Rabata Service in accordance with the Documentation.
1.2 Registration of Customer Accounts
You must register an account with us in order to use the Rabata Service. You agree to provide accurate and complete information.
1.3 Third-Party Content
Third-Party Content made available by Rabata through the Rabata Service, if any, may be used by you, solely at your option.
1.4 Usage Data
To provide billing and administration services, we may process usage data related to your Customer Account.
2. Rabata Changes; Support and Maintenance
We may change or discontinue any or all of the Rabata Service from time to time. We will notify you of any material change.
3. Security and Data Privacy
We implement appropriate technical and organizational measures to ensure security of your data. See our Privacy Policy.
4. License Grant; Acknowledgment
You retain all rights to Your Content. You grant Rabata a limited license to store and process Your Content solely for providing the Service.
5. Fees and Payment
Fees for the Service are described in your selected plan. All fees are exclusive of taxes unless otherwise stated.
6. Proprietary Rights; Confidentiality
Rabata retains all rights in the Service. You retain all rights in Your Content.
7. Term; Termination; Suspension
Either party may terminate this Agreement at any time. Upon termination, you may export Your Content within 30 days.
8. Indemnification
You agree to indemnify Rabata from any claims arising from your use of the Service or violation of these Terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS." RABATA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
